A COLBY MAN WAS SENTENCED IN A PLEA AGREEMENT IN NORTON COUNTY MAGISTRATE COURT.  KYLE WITHINGTON WAS CHARGED WITH ONE COUNT EACH OF SPEEDING, 71 IN A 55 MILE PER HOUR ZONE, AND DRIVING UNDER THE INFLUENCE.  THOSE CHARGES ARE IN CONNECTION WITH AN ALLEGED NOVEMBER 4TH INCIDENT.  WITHINGTON MADE HIS FIRST APPEARANCE NOVEMBER 23RD.  HE WAS ARRAIGNED ON DECEMBER 14TH AND PLED NOT GUILTY.  AT HIS BENCH TRIAL, WITHINGTON PLED GUILTY TO SECOND OFFENCE D.U.I. AND THE SPEEDING CHARGE WAS DISMISSED.  HE WAS SENTENCED TO 12 MONTHS IN THE COUNTY JAIL SUSPENDED TO 12 MONTHS PROBATION.  WITHINGTON MUST SERVE 5 DAYS IN JAIL, OF WHICH MUST BE 48 HOURS IN JAIL AND THE OTHER THREE DAYS ON HOUSE ARREST, WITH THE POSSIBILITY OF WORK RELEASE.  HE WAS FINED 1,250 DOLLARS, K.B.I. LAB FEE OF 400, COURT COSTS OF 98, AND A BOOKING FEE OF 45.  WITHINGTON MUST UNDERGO AN ADSAP EVALUATION AND PRESENT THE RESULTS AND PROGRESS REPORT TO THE COURT, ACCORDING TO MAGISTRATE JUDGE DEBRA ANDERSON.
