A STOCKTON MAN WILL BE SERVING THE REST OF HIS TERM IN PRISON FOR A VIOLATION OF HIS PROBATION.  CARLOS GALLOWAY WAS CHARGED WITH BURGLARY AND THEFT BOTH FELONIES.  THOSE CHARGES ARE IN CONNECTION WITH THE ALLEGED JULY 16TH 2009 BURGLARY AND THEFT OF THE HOME OF ED DESBEIN IN ALMENA.  GALLOWAY ENTERED INTO A TWO YEAR DIVERSION AGREEMENT.  IN 2111, HE DID NOT COMPLETE THE DIVERSION.  IN PLEA AGREEMENT, GALLOWAY PLED GUILTY TO AN AMENDED COUNT OF FELONY THEFT AND THE BURGLARY CHARGE WAS DISMISSED.  HE WAS SENTENCED TO SIX MONTHS WITH THE KANSAS DEPARTMENT OF CORRECTIONS, SUSPENDED TO 12 MONTHS ON COMMUNITY CORRECTIONS.  GALLOWAY WAS TO SERVE 30 DAYS IN THE COUNTY JAIL AND WILL THEN BE RELEASED.  HE IS ORDERED TO FIND EMPLOYMENT WITHIN TWO WEEKS AND IF NOT WILL BE RETURNED TO JAIL.  HIS COMMUNITY CORRECTIONS WAS REVOKED AT THE JULY MOTION DAY AND HE WAS ORDERED TO THE KANSAS DEPARTMENT OF CORRECTIONS TO SERVE HIS SIX MONTHS IN JAIL, ACCORDING TO NORTON COUNTY ATTORNEY DOUG SEBELIUS.  HE WAS GIVEN CREDIT FOR 71 DAYS ALREADY SERVED.
